Local governments across the world are in the middle of technological and economic developments that come together in the catch-all label of smart cities or innovative cities. In a smart city, ICT-infused infrastructures enable the extensive monitoring and steering of city maintenance, mobility, air and water quality, energy usage, among others. The effect of growing population and the challenges regarding urbanization and environmental sustainability have led the European Union to adopt different policies and initiatives to promote this new city model. Nevertheless, such processes use and produce massive amounts of data, which could affect people's privacy. Countries like Spain have begun to invest in smart cities and Artificial Intelligence projects to improve efficiency in the public sector. However, the use of artificial intelligence can generate several problems such as opacity, legal uncertainty, or breaches of personal data protection. Therefore, the goal of this article is to identify the main legal challenges for public administrations derived from the development of innovative cities and the use of AI regarding to privacy. ; Los gobiernos locales de todo el mundo se encuentran en medio de desarrollos tecnológicos y económicos que se unen en la etiqueta general de ciudades inteligentes o ciudades innovadoras. El efecto del crecimiento demográfico y los desafíos en materia de urbanización y sostenibilidad ambiental han llevado a la Unión Europea a adoptar diferentes políticas e iniciativas para impulsar este nuevo modelo de ciudad. The expanding use of artificial intelligence (AI) in public administration is generating numerous opportunities for governments. Current Spanish regulations have established electronic administration and support the expansion and implementation of this new technology, but they may not be adapted to the legal needs caused by AI. Consequently, this research aims to identify the risks associated with AI uses in Spanish public administration and if the legal mechanisms can solve them. We answer these questions by employing a qualitative research approach, conducting semi-structured interviews with several experts in the matter. Despite the benefits that this technology may involve, throughout this research we can confirm that the use of artificial intelligence can generate several problems such as opacity, legal uncertainty, biases, or breaches of personal data protection. The mechanisms already provided by Spanish law are not enough to avoid these risks as they have not been designed to face the use of artificial intelligence in public administration. In addition, a homogeneous legal definition of AI needs to be established.

Este trabajo tiene como objetivo analizar los elementos que han llevado a la invalidación del actual Privacy Shield, el acuerdo entre la Unión Europea y Estados Unidos para las transferencias transfronterizas de datos, como consecuencia de la sentencia Schrems II. Para ello, este artículo se enfoca en establecer el concepto de nivel adecuado y decisión de adecuación a través del análisis legal y revisión de la literatura. Una vez estudiados, se examinan tras una breve contextualización del acuerdo que lo precedió, las lagunas o problemas iniciales del Privacy Shield, así como la argumentación dada por el Tribunal de Justicia de la Unión Europea para su invalidación.

The increase of visibility and transfer of scholar knowledge through digital environments have been followed by the author's rights abuses such as plagiarism and fraud. For this reason, copyright is increasingly a topic of major importance since it provides authors with a set of rights to enable them to utilize their work and to be recognized as the creators. The new research methods linked to technological advances (such as data mining) and the emergence of systems such as Open Access (OA) are currently under debate. These issues have generated legislative changes at the level of the European Union (EU) and its Member States. For this reason, it is relevant that the researchers know how to protect their work and the proper use of another's work. Consequently, this research aims to identify the limitations of copyright in the EU and as a specific case in Spain, within the framework of scientific research. For this, the changes in the European and Spanish copyright regulations are analyzed. The results confirm new exceptions and limitations for researchers related to technological evolution, such as data mining. In the present study, an analysis of data protection as a legal concept is carried out in the European Union and in the United States, as well as a brief overview of its legislative evolution. The theoretical and normative development that has taken place in the European Union reveals the importance of the digital identity of its citizens. Nevertheless, due to the characteristics of the American legislation, the free flow of data between entities has more strength. The importance of this study lies in the fact that the understanding of the data protection concept in both systems will allow us to have a better perspective on the weaknesses and strengths that may exist in the agreements for the transfer of personal data between the European Union and the USA. ; En el presente estudio se realiza un análisis del concepto legal de protección datos tanto a nivel normativo en la Unión Europa como en Estados Unidos, al igual que una breve visión de su evolución legislativa. El largo desarrollo teórico y normativo que ha habido en la Unión Europea deja entrever la importancia de la identidad digital de sus ciudadanos, mientras que la legislación norteamericana, más esparcida y sectorial, revela la fuerza que otorga al libre flujo de datos entre las entidades mercantiles. La importancia del presente estudio reside en que la comprensión de la concepción sobre la protección de datos en ambos sistemas, permitirá tener una mejor perspectiva sobre las debilidades y fortalezas que puedan existir en los acuerdos entre la Unión Europea y EE.
